Unpermitted food

We work to safeguard public health and ensure that food served to consumers is safe, unadulterated, and honestly presented, by regulating the food sold or distributed to the public.

Food poisoning

If you experience foodborne illness, or food poisoning, and believe it is related to a retail food facility operating in the County of Santa Clara, file a foodborne illness report.

Does DEH investigate?Issue
YesUnpermitted food vendors are people who are selling/peddling food on a cart, truck, trailers, table, from the trunk of cars, or from their home without a permit to operate from the Department of Environmental Health.

Vendors who peddle and sell only prepackaged non-potentially hazardous foods and whole, uncut produce at a display less than 25 square feet are exempt from obtaining a permit to operate from the Department of Environmental Health.
NoAnything unrelated to food safety, such as the level of service received. This type of complaint is not within our legal jurisdiction and should be directed to the food facility manager, owner, or corporate office.

We only investigate noise pollution in County's unincorporated areas. Describe the following:

  1. The noise pollution source.
  2. The noise in detail (e.g., loud screech, whine, grind, bang, music, etc.).
  3. The frequency in which the noise is occurring (e.g., sporadically, continuously).
  4. The dates and times of the occurrences.
  5. The background noise at your location (e.g., freeway, animals, truck traffic, crickets, etc.) and list anything that you believe could interfere with measuring the primary noise.
  6. Any other information that would assist us in investigating the issue (e.g., a specific pattern of occurrence or schedules that can be replicated during a monitoring event)

 

For example, name the business where problem occurred.

The business or place must be located in Santa Clara County California for DEH to take action. 

For example, the address of a business or a description of the location.
